Historic Coast Pressure Washing is a pressure washing and soft washing business based in St. Augustine, Florida. Website: historiccoastpressurewashing.com. Email: hello@historiccoastpressurewashing.com.
These Terms of Service are a binding agreement between you and Historic Coast Pressure Washing ("we", "us"). They cover the pressure washing, soft washing, sealing and related exterior work you book through historiccoastpressurewashing.com or with our office, your use of the site, and paying us. By requesting a quote, booking or receiving our services, paying us or using the site, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the site or our services.
Please read section 24 carefully. It requires most disputes to be resolved by individual binding arbitration instead of in court, and it waives class actions and jury trials. You can opt out of arbitration within 30 days, as section 24 explains.
If you are a commercial account and we have signed a separate written service agreement, that agreement controls where it conflicts with these terms.
1. Who can use our services
You must be at least 18 and able to enter a contract. You confirm that you own the property or have the authority to approve the work and to give us access to the areas we will wash. If you book for someone else, such as a tenant, owner, HOA or business, you confirm you are authorized to act for them and you agree to these terms on their behalf as well as your own. We wash a neighbour's side of a fence only with the neighbour's permission.
2. Estimates and prices
The instant quote is an estimate from our published rate card based on the sizes and details you enter. We confirm it from your photos or a quick look before work starts. If the size or condition is materially different, we quote the difference to you first and you decide; we never add it after the fact. The confirmed price is the price you pay for the work described.
Outside our core service area the quote includes a travel adjustment, shown up front and confirmed before we book. If a quote contains an obvious pricing error, we will tell you and correct it before the work begins, and you may decline. Sales tax is added only where Florida law requires it.
3. Scheduling and arrival
We book a day and give you an approximate arrival time, not an exact one. Traffic, weather and earlier jobs can move it, and we will let you know if we are running late. We start no earlier than 7am (9am on Sundays). You do not need to be home, as long as we have a working outside water spigot and access to the areas being washed. Your tech checks in on arrival and out when finished, so there is a record of when the work was done.
4. Changes, cancellations and weather
- You may move or cancel a visit at no charge with at least 48 hours notice.
- We reschedule for rain, high wind or lightning at no charge. We may also move a visit because of storms, hurricane watches and warnings, emergencies or staff illness; we will tell you as soon as we can and will not charge you for a visit we move.
- A lockout, where we arrive and cannot get water or access, may be billed at up to 50% of the visit price.
5. What we need from you
- A working outside water spigot, access to every area being washed, windows and doors closed, and vehicles moved off surfaces we are cleaning.
- Tell us about anything that needs special care: fresh paint, loose or chalking paint, failing old sealer, cracked tiles, damaged screens, outdoor electrical, koi ponds or delicate plants.
- Move outdoor furniture, decorations and other loose items out of the areas being washed, or tell us about them before we start.
- Tell us about known hazards on the property, such as damaged outdoor wiring or loose railings.
- Provide a safe place to work. We may decline or stop work, and leave, if conditions put our team at risk or anyone is threatening or harassing.
6. Existing conditions
Washing reveals the true condition of a surface. Loose or chalking paint, oxidized siding, failing caulk or sealer, cracked or brittle roof tiles and torn screens can lift or show more once clean. We point out what we see before we start and we use low pressure on delicate surfaces, but we are not responsible for damage caused by a pre-existing defect. Some stains (rust, oil, irrigation and fertilizer stains, tannin) lighten but may not disappear completely.
7. Plants, runoff and chemicals
We use diluted cleaning mixes at the strength the surface needs, wet plants before we start and rinse them after. We do not send wash water or cleaning mix into storm drains. Keep pets and children away from work areas until surfaces are dry.
8. Paver sealing
When we seal pavers, we leave the cure time in writing. Keep foot traffic and vehicles off the sealed surface until that time has passed. We are not responsible for marks, tracking or damage caused by use before then, or by sprinklers or irrigation left running during the cure time.
9. What our services do not include
Unless we agree otherwise in writing: we clean roofs but do not coat, seal or repair them; we do not clean windows (a building wash rinses entry glass only); we do not stain decks or fences; and we do not repair paint, caulk, screens, tiles or other surfaces. If washing shows that something needs repair, we will point it out so you can arrange it.
10. Plans
A plan books recurring visits at the plan price, on a schedule such as once a year, twice a year or every three months, or for businesses monthly, every two weeks or weekly. Unless your plan is billed monthly, each visit is invoiced when it is finished. Cancel any time before the next visit. Sealing is a one-time job and is never part of a plan. If we change a plan's price, we will tell you at least 30 days before the change takes effect, and you may cancel before then.
11. Monthly billing
- A plan can be billed monthly instead of per visit: one invoice for a fixed amount on the plan's billing day, in advance, for that calendar month. Visits on a monthly-billed plan are not invoiced separately.
- The monthly amount spreads the cost of the plan's visits evenly across the months, so it stays the same in months with a visit and in months without one. For example, a twice-a-year plan billed monthly costs about one sixth of a visit's price each month.
- You receive an invoice for every monthly charge. You can pay it from its payment link, or have it charged automatically as section 13 explains.
- You may cancel a monthly-billed plan at any time by emailing hello@historiccoastpressurewashing.com or telling our office. Once you cancel, we do not bill you for any further months.
12. Payment
- Visits are invoiced when they are finished, or monthly for a monthly-billed plan, and payment is due on receipt unless a commercial account has agreed other terms in writing.
- You can pay by card through the secure invoice link or your client account page, or by check or cash. Card payments are processed by Stripe, and we never see or store your card number.
- A returned check may be charged the service fee Florida law allows.
- If an invoice is past due, we may pause your visits until it is paid. You agree to pay reasonable costs of collection, including attorney's fees, to the extent the law allows.
- If you believe a charge is wrong, tell us within 60 days of the invoice. Please contact us before disputing a charge with your card issuer, so we can resolve it quickly.
13. Automatic payments and saved cards
- Automatic payments are optional and available for plans billed monthly. You turn them on by ticking the authorization box when you pay a monthly invoice. That saves your card with Stripe, on your customer record there; we keep only its brand, last four digits and expiration date, together with the exact authorization you agreed to, when, and from which IP address.
- By turning them on, you authorize us to charge the saved card on each billing day for your plan's monthly amount plus any applicable sales tax, until you turn automatic payments off.
- You receive an invoice for every charge.
- You can turn automatic payments off at any time from your client account page or by emailing us. Doing so removes the saved card and switches the plan back to a monthly invoice with a payment link. It does not cancel the plan.
- If a charge is declined, the invoice stays open with its payment link and we try the card once more three days later. Please keep your card details current.
14. Our guarantee
If we missed a spot, tell us within 7 days of the visit and we come back and rewash that area at no charge. A rewash is the remedy under this guarantee. It does not cover areas outside the service you booked, stains that washing cannot fully remove (see section 6), or new growth, dirt or stains that appear after the visit.
15. Property and claims
Report any damage claim within 48 hours of the visit, with photos, so we can look at it while it is fresh. If the damage was caused by our negligence, we will, at our choice, repair or replace what was damaged, or pay the reasonable repair cost or its actual cash value. Actual cash value means its value at the time, not the cost of a new one.
We are not responsible for: damage caused by a pre-existing defect (see section 6); results of following your instructions; surfaces or items you did not tell us need special care; loose items left in the areas being washed; water that gets in through windows or doors left open or through seals that were already failing; or loss caused by events outside our reasonable control.
16. Gate codes and access
We keep gate codes and other access details you give us confidential and use them only for your visits; the techs assigned to your visits can see them. Tell us when a code changes. If your HOA or community requires notice or a vendor pass before we can enter, please tell us or arrange it.
17. Photos
Photos you upload with a quote are kept with your quote records, and our techs may photograph the work on the job. We do not publish photos of your property without asking you first. If you upload photos with a quote, you allow us to use them to prepare the quote and do the work.
18. Using this website
You may use the site for your own personal or business use in dealing with us. You agree not to: enter false information or someone else's details; submit automated or bulk requests; copy, scrape or resell the site's content or pricing; try to get around its security or access areas you are not authorized to use; or interfere with how it works. The site's content, design, name and logos belong to us. Information on the site is provided for general purposes, may change without notice, and may contain errors, which we may correct at any time. Links to other websites are provided for convenience; we are not responsible for their content.
19. Messages you agree to receive
You agree that we may contact you by email, phone and, if you agree to texts, text message about your quotes, visits, invoices and account. You agree that notices, invoices and records may be provided electronically, and that clicking or ticking to accept on the site has the same effect as a signature.
20. Disclaimer of warranties
We will perform our services with reasonable care and skill. Apart from that promise and the guarantee in section 14, and to the fullest extent the law allows, the site and our services are provided "as is", and we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
21. Limitation of liability
To the fullest extent the law allows: (a) we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or loss of use, even if we were told they were possible; and (b) our total liability for any claim arising out of the site or our services is limited to the amount you paid us for the specific service that gave rise to the claim. Section 15 describes how we handle property damage. Nothing in these terms limits liability for our gross negligence or intentional misconduct, or any liability the law does not allow us to limit.
22. Your responsibility to us
To the extent the law allows, you agree to defend and indemnify us and our team against claims, losses and costs, including reasonable attorney's fees, that arise from your breach of these terms, hazards or conditions you did not disclose, work on areas you had no right to approve, or work done as you instructed.
23. Events outside our control
We are not responsible for delay or failure caused by events beyond our reasonable control, including hurricanes, tropical storms, floods, severe weather, fire, power or water outages, road closures, government orders, epidemics, labor shortages or supplier failures.
24. Resolving disputes: arbitration, class action waiver and jury waiver
Talk to us first. If you have a dispute with us, email hello@historiccoastpressurewashing.com with your name, address and a description of the problem and what you want. We will try in good faith to resolve it within 30 days. Neither of us will start arbitration or a lawsuit until that 30 days has passed.
Binding arbitration. Any dispute or claim between you and us arising out of or relating to the site, our services, an invoice, or these terms, that we cannot resolve informally, will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (or its Commercial Arbitration Rules if you are a commercial account). The arbitrator decides all questions about whether a dispute must be arbitrated, except that a court decides questions about the class action waiver below. Arbitration fees are paid as the AAA's rules provide. The hearing will take place in St. Johns County, Florida, or by phone or video. The arbitrator may award the same individual relief a court could, and judgment on the award may be entered in any court with jurisdiction. The Federal Arbitration Act governs this section.
Exceptions. Either of us may bring an individual claim in small claims court instead of arbitration if it qualifies. Either of us may ask a court to stop misuse of the site or of our name or content.
Class action waiver. You and we each agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective or representative proceeding. If this waiver is found unenforceable for a claim, that claim must proceed in court, not in arbitration.
Opting out. You may opt out of this arbitration agreement by emailing hello@historiccoastpressurewashing.com within 30 days after you first accept these terms, with your name, service address and a statement that you opt out of arbitration. Opting out does not affect the rest of these terms.
Court and jury waiver. Any dispute not resolved by arbitration will be decided exclusively by the state or federal courts for St. Johns County, Florida, and you and we consent to their jurisdiction. YOU AND WE EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY SUCH DISPUTE.
25. Governing law and attorney's fees
These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules, and by the Federal Arbitration Act for section 24. In any arbitration or lawsuit to enforce these terms, the prevailing party may recover its reasonable attorney's fees and costs.
26. Changes to these terms
We may update these terms. The date at the top shows when they last changed. If you are on a recurring plan, we will email you about material changes at least 30 days before they take effect, and you may cancel before then. Using the site or our services after a change takes effect means you accept it. A change to section 24 will not apply to a dispute you have already told us about.
27. General
These terms, together with your confirmed quote or invoice and our Privacy Policy, are the entire agreement between you and us about their subject. If any part is found unenforceable, the rest stays in effect and that part is enforced to the fullest extent allowed. If we do not enforce a right, we have not waived it. You may not transfer your rights under these terms without our consent; we may transfer ours to a successor business. Sections that by their nature should continue after service ends, including payment, property and claims, limitation of liability, indemnity and dispute resolution, continue. Nothing in these terms limits any right to cancel that a Florida or federal cooling-off law gives you for a purchase agreed to at your home.
